Adresio – a brand of Fawana GmbH
Breitfeldstrasse 31, 3014 Bern | CHE-496.416.183
1. Applicability and parties to the contract
1.1 These General Terms and Conditions govern the contractual relationship between Fawana GmbH, Breitfeldstrasse 31, 3014 Bern (hereinafter “Adresio” or “us”) and the user (hereinafter “User” or “User”).
1.2 Adresio provides its services exclusively to natural persons (private individuals) with a residence in Switzerland who are changing their residence within Switzerland (B2C). By using and paying for the service, the User explicitly confirms that they are at least 18 years old. Persons under 18 years of age may only use the platform with proven written consent of a legal representative, which must be submitted to Adresio on request.
1.3 By paying for a order, the User accepts these GTCs in full and irrevocably. Any other conditions of the User are not recognized, even if they are not explicitly contradicted.
1.4 Applicable is the version of the GTCs in force at the time of placing the order, accessible at adresio.ch/gct. Subsequent changes to the GTCs are not retroactive for orders already paid.
2. Description of Services
2.1 Core Service
Adresio transmits, on behalf of and at the express direction of the User, their new residential address and the necessary personal data to the authorities and private entities selected by them. Adresio acts exclusively as an intermediary and authorized representative of the User — not as a self-responsible party to the reporting bodies.
2.2 Service Packages (Tiers)
The package is automatically assigned based on the number of selected services. The user selects services, not packages; the package is determined by this:
| Package | Services | Price |
|---|---|---|
| Basic | 1–2 services | CHF 49 |
| Comfort | 3–5 services | CHF 59 |
| Reliable | 6+ services | CHF 79 |
All prices include VAT, if applicable. The package and price are fixed upon payment. Changes to the service selection after payment require a new, separate order and payment.
2.3 Types of service delivery
Adresio provides notifications based on technical possibilities in one of three modes. The applicable mode for each service is accessible at adresio.ch/services and is communicated transparently to the user before data entry.
Mode A — Automatically («Auto»): Adresio automatically sends the address change via direct API connection or ePost. No human intervention in the data transmission. The user receives a system-generated confirmation email.
Modus B — Portal («Manuell-Digital»): For authorities and offices that do not offer an API connection (currently eUmzugCH), Adresio manually enters the user's data on behalf of and at the user's request into the appropriate authority portal or third-party portal. The receipt confirmation is sent directly to the user's email address by the respective portal. Since there may be data transfer errors with manual data entry by Adresio, the user must verify the accuracy of the entered data and report any errors within 5 business days after receiving the confirmation. Unreported errors are considered accepted; Adresio is not liable for any consequential damages arising from them.
Modus C — Postal («Post»): For offices that accept address changes only by mail (currently certain banks and private insurers), Adresio creates and sends a physical letter with the necessary information on behalf of the user. Adresio sends postal notifications as B-Post by the Swiss Post AG, unless the user explicitly requests registered mail (A-Post Plus). As proof of delivery, the delivery receipt (registered mail) or internal shipping documentation (B-Post) is used. Adresio is not liable for delays, loss, or damage by the Swiss Post AG after the point of dispatch. The user assumes the delivery risk for postal shipments.
Modus Changes: The classification of a service may change due to technical or regulatory changes by third parties. A change in the Modus does not entitle the user to a refund, unless the service is still provided in the modified Modus.
2.4 Non-deliverable Services
If a selected service cannot be provided (e.g., provider is not in the system, API failure by third party), Adresio notifies the user by email and provides instructions for manual reporting. No refund will be issued for individual non-delivered services, provided that the other services in the package are delivered correctly. If the non-delivered service is the only service provided, §4.2 (Benevolence Rule) applies.
3. Contract Closure and Payment Model ("Payment-First")
3.1 The contract is formed with the receipt of the full payment. The automatically sent order confirmation by email serves as a contract document.
3.2 Advance Payment Model: The user selects services (number and categories, without entering personal data), pays, and provides the necessary personal information only after successful payment. This procedure aims to minimize the amount of data collected before payment.
3.3 With the completion of payment, Adresio starts providing the platform. The service is considered to have begun at this point.
3.4 Data Input Deadline: The user has 90 days to complete all data input after payment. If the deadline is exceeded without completing the data input, the order expires without a refund. Adresio reminds the user 14 days and 3 days before the deadline by email.
3.5 Accepted payment methods: TWINT, credit and debit cards (Visa, Mastercard), and other methods offered by Worldline. Payment processing is carried out by Worldline Schweiz AG in accordance with PCI-DSS standards. The selection of payment methods may change without prior notice as long as at least one payment method remains available.
4. Cancellation and Refund Policy
4.1 No statutory right to cancel: The Swiss Obligations Act provides no statutory right to cancel for digital services that are immediately started upon the user's express request following contract execution. By payment, the user expressly agrees to the immediate commencement of service and the exclusion of a right to cancel.
4.2 Cancellation before data entry: Until the first data entry after payment, the user may cancel the order via email at support@adresio.ch and will receive a full refund within 10 business days — after review by Adresio — once the data entry process begins, cancellation and refund are excluded.
4.3 Exclusion of chargebacks: The user agrees to first use direct contact via support@adresio.ch before initiating a chargeback procedure with their payment service provider. Unjustified chargebacks — especially if the service has already been provided or started — constitute a breach of contract. Adresio reserves the right to recover any applicable processing and collection costs incurred due to unjustified chargebacks from the user.
4.4 The worry-free guarantee (§8) remains unaffected by the cancellation policy.
5. Duties, Participation and Misuse Prohibition
5.1 Accuracy of Entries: The user is required to enter all information completely, truthfully and up-to-date. Adresio expressly does not take responsibility for any damage caused by false, incomplete or outdated information entered by the user — including consequential costs with authorities or third parties.
5.2 Identity and Authority: The user expressly confirms upon data entry that they:
- initiate the address change exclusively for themselves, or
- have a valid power of attorney or the express consent of other persons (partners/partners, children, roommates/roommates) to do so.
5.3 Misuse Prohibition: It is expressly forbidden to the user, at full civil and criminal legal responsibility, to use the platform to:
- initiate address changes for third parties without their knowledge and consent;
- deceive authorities or private entities by providing false identity or address information;
- use the platform for unauthorized actions, fraud or identity theft.
Adresio does not take responsibility for any damages caused to the user, third parties or authorities in these cases. The user releases Adresio from any claims from third parties arising from improper use. Adresio is authorized to report suspected cases to the relevant authorities.
5.4 Guided Services: In accompanied services, the user is solely responsible for the actual execution on the third-party platform. Adresio provides guidance and preparation — not final execution. With confirmation of completion in the dashboard, the user assumes responsibility for the completeness of the submission.
5.5 Email Availability: The user maintains their email address up to date. Adresio cannot be held liable if important notifications (Magic Link, status updates, deadline warnings) are not received by the user because of an outdated or incorrect email address.
6. Authorization and Consent to Data Transfer
6.1 By checking the checkbox («I authorize Adresio to forward my address change and the necessary data on my behalf to the selected parties») the user expressly authorizes Fawana GmbH (trading as Adresio) to forward data according to Art. 32 ff. OR on their behalf:
- to report the address change to the selected authorities and private entities;
- to provide the necessary personal data (name, date of birth, addresses, and service-specific information such as insurance, customer, or vehicle identification numbers);
- to receive confirmations and feedback from the recipients.
6.2 Data Transfer as a Core Component of the Service: The user is informed and explicitly consents that providing the service necessarily includes transferring their personal data to the third parties selected by them (authorities, insurers, telco providers, banks, etc.). These third parties are self-responsible data controllers from the time of data transfer and process the received data according to their own privacy policies. Adresio has no influence on their downstream data processing.
6.3 Scope and Limitation: The power of attorney is limited exclusively to the transmission of the address change and the necessary data. It does not cover contract changes, termination, new contracts, or other legal actions with recipients.
6.4 Third Parties: If the user initiates the address change for other household members, she confirms that these individuals have granted her express consent or that she is legally authorized to act on their behalf. Adresio is not liable for damages resulting from unauthorized data transfer by the user to third parties.
6.5 Qualified Signature: For reporting points requiring a qualified electronic signature (particularly certain canton authorities), the user is directed to the corresponding signature process (SwissID or equivalent provider). If the user is unwilling or unable to provide the qualified signature, Adresio cannot deliver the relevant report; no refund claim for this service exists.
6.6 Audit Log: Adresio records the time, IP address, and technical identifier of each power of attorney grant and each data transfer as a revision-proof audit log in accordance with revDSG. This log serves as evidence of the granted consent and can be provided to the user upon request.
7. Liability
7.1 Principle: Adresio is liable for damages caused by intentional or gross negligence of Adresio or its agents, without limitation.
7.2 Limitation for Simple Negligence: In cases of simple negligence, Adresio’s liability is limited to the actual billed service fee (up to CHF 79), to the extent that this is permitted by mandatory Swiss law.
7.3 Excluded Liability Areas: Adresio expressly does not hold liability for:
- Errors resulting from incorrect, incomplete, or outdated user input
- Delays, refusals, or errors by the receiving entities (government agencies, insurance companies, telco providers, etc.), regardless of the transmission method
- Downtime, portal changes, or system disruptions by third-party providers (eUmzugCH, ASTRA, canton portals, SwissID, Worldline, Infomaniak, etc.) outside Adresio’s influence
- Inaccessibility of the user due to outdated email addresses or expired Magic Links
- Services where the user has already confirmed completion in the Dashboard (Modus D: Guided)
- Delivery delays or loss of postal mail (Modus C) after submission to Swiss Post AG
- Errors in portal submissions (Modus B), not contested by the user within the 5-working-day review period
- Indirect damages, consequential damages, lost profits, or any other non-material damages
- Damages from the user’s or third parties’ abusive use of the platform
7.4 Liability for Manual Data Entry (Mode B): For errors Adresio has proven to have caused itself in manually entering user data into government or third-party portals (typo errors, wrong entries), Adresio is liable within the limitations under §7.2. The user must report the error within the 5-working-day review period (§2.3 Mode B). This limitation does not apply to errors caused intentionally or grossly negligently.
7.5 Government Decisions: Adresio does not guarantee that government bodies will accept address changes without further inquiries. Contentual denials by government bodies — even if the notice is correctly sent — do not entitle to a refund. Adresio informs the user via email upon knowledge of a denial and provides guidance on the next steps.
7.5 User Discharge: The user discharges Adresio from all claims, costs, and damages that may be caused by third parties or government bodies due to incorrect information, abusive use, or breach of these Terms and Conditions by the user.
8. Hassle-Free Guarantee
8.1 Requirements: Adresio offers a worry-free guarantee with a refund claim if all of the following conditions are met:
- The user has entered all necessary data fully and correctly
- The affected service was obviously not provided (not just delayed or rejected by the authority in substance)
- The failure is obviously and demonstrably on Adresio's side — not on the receiving party, the payment provider, or the user
- The user reports the problem within 14 days after the communicated expected processing time on the platform via email to support@adresio.ch
8.2 Burden of Proof and Review Process: The burden of proof for an Adresio-side failure lies with the user. Adresio is authorized to review the audit log, processing record (Modus B), or shipping receipt (Modus C) within 14 working days after receiving the complaint and make a reasoned decision. The user must cooperate reasonably on request (e.g., request information from the complaint-handling office about receipt).
8.3 Guarantee Scope by Modus:
| Modus | What is covered | What is not covered |
|---|---|---|
| A (Auto) | Complete non-delivery proven by Adresio system | Third-party technical failures, in-substance rejections |
| B (Portal/Manually) | Typo or false entry by Adresio, reported within 5 working days; complete non-processing | Errors not reported within 5 working days; portal failures |
| C (Post) | Proven non-submission of the delivery by Adresio | Loss/delay by Swiss Post after submission; Non-processing by recipient |
8.4 Refund Amount: Adresio will reimburse the proportionate amount for the single service not provided, but no more than the total amount paid. An overcompensation (e.g., refund + damages) does not occur under this guarantee.
8.5 Exclusions: The worry-free guarantee expressly does not apply to:
- Guided services (Modus D), in which the user has confirmed the completion in the dashboard
- Delays or content denials by receiving parties, regardless of the transmission mode
- Services in which the user entered false or incomplete data
- Services that could not be performed due to higher force (§9)
- Cases in which the user's qualified signature was missing and required
- Postal communications for which the shipping receipt was provided
- Complaints outside the 14-day notice period
9. Force Majeure
9.1 Adresio is relieved of its performance obligation to the extent that performance is prevented or significantly hindered by circumstances that are outside of Adresio's control and were not foreseeable at the time of contract signing. Examples include:
- Failure, suspension, or cessation of government API access (eUmzugCH, ASTRA, cantonal systems)
- Technical outages or failures with infrastructure partners (Infomaniak, Worldline, SwissID)
- Legal or governmental orders that prevent performance
- Natural disasters, pandemics, cyberattacks on third-party infrastructure
- System failures at reporting stations
9.2 Adresio promptly informs the user of such an event and its estimated duration. If the impediment lasts longer than 30 days, both parties are entitled to terminate the contract in writing. In this case, Adresio reimburses the amount for the services not yet rendered on an equal share basis.
9.3 Delays or failures of individual services due to higher force majeure do not entitle the user to invoke the worry-free guarantee (§8).
10. Adresio's Suspension and Termination
10.1 Adresio is entitled to suspend or terminate an order immediately if:
- there is a reasonable suspicion of fraud, identity theft, or unauthorized use
- the user provided false identification
- the user initiated a chargeback process
- the user violates these Terms and Conditions
10.2 In the event of a justified suspension, there is no refund claim for services already rendered. For services yet to be rendered, Adresio reimburses the proportionate amount minus a flat fee of CHF 15 for processing.
10.3 Adresio reserves the right to refuse to provide new services to a user if past misuse or unjustified chargebacks have been detected.
11. Contract Transfer
11.1 Adresio is entitled to transfer all rights and obligations arising from this contract relationship to a successor company (including a future "Adresio GmbH") without separate consent from the user, provided the successor company provides the same services under the same conditions and the data protection standards of these Terms and Conditions remain unchanged.
11.2 Adresio will inform the user of such a transfer by email at least 14 days in advance. Active orders that have not yet been completed at the time of the transfer will be continued seamlessly by the successor company.
11.3 The user may not transfer rights or obligations under this contract to third parties without Adresio’s prior written consent.
12. Access to the Platform (Magic Link)
12.1 The Adresio platform is accessed using a personal access link ("Magic Link") sent to the email address provided. Each Magic Link is valid for 72 hours from the time it is sent. A new link can be requested through the platform at any time.
12.2 The personal status dashboard remains accessible for 24 months after completion of the order. The data will then be archived or deleted in accordance with the Privacy Policy. Before this period expires, the user can download a PDF summary of the order as evidence.
12.3 The user is responsible for ensuring that the Magic Link is not shared with third parties. Adresio is not liable for damage resulting from misuse of a shared Magic Link.
13. Communications and Reminders
13.1 Adresio sends the following transactional emails: order confirmation, payment receipt, status updates for automatic notifications, reminders for outstanding guided services (after 24 and 72 hours), warnings concerning the data-entry deadline (§3.4), and completion confirmation.
13.2 After the second reminder for an outstanding guided service, Adresio will not send further reminder emails. Outstanding tasks remain visible in the dashboard.
13.3 The user can unsubscribe from optional reminders at any time by contacting support@adresio.ch. Transactional emails (payment receipts and status updates) cannot be unsubscribed from because they are required to perform the contract.
14. Data Protection
Personal data is processed in accordance with the Adresio Privacy Policy (adresio.ch/datenschutz), which forms an integral part of these Terms and Conditions.
15. Changes to the Terms and Conditions
15.1 Adresio reserves the right to amend these Terms and Conditions. Material changes will be communicated to the user by email at least 30 days before they take effect and published at adresio.ch/agb.
15.2 Orders that have already been paid for and are in progress will be processed under the Terms and Conditions in effect at the time of the order.
16. Applicable Law and Place of Jurisdiction
16.1 This contractual relationship is governed exclusively by Swiss law, excluding the Swiss Federal Act on Private International Law (PILA) and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
16.2 The exclusive place of jurisdiction is Bern, Switzerland. Adresio may also bring proceedings against the user before the courts at the user’s place of residence.
16.3 Mandatory provisions of Swiss consumer protection law remain unaffected.
17. Severability
If any provision of these Terms and Conditions is wholly or partly invalid, the validity of the remaining provisions will not be affected. The invalid provision will be replaced by a valid provision that most closely reflects its economic purpose.
